Legal Help With Your Priorities in View

The legal category is only part of the problem. A custody disagreement may disrupt a child’s routine. A DWI allegation may complicate travel to work. A restraining order may immediately affect where someone can live and whom they can contact.

We begin with those practical concerns, then connect them to the legal process. You should understand which restrictions already apply, which information is missing, and which decisions may come next. A clear plan helps you respond deliberately rather than reacting to every document or message.

How Lawyer Fees Work at Omojola Law

Cost is one of the first questions clients ask, and it deserves a straight answer. In this video, Attorney Ade Omojola explains how legal fees work at Omojola Law and why the firm offers flat-fee and payment-plan options for many matters.

An hourly rate bills for every phone call, email, and court appearance, which can make the final cost hard to predict. A flat fee sets the price for a defined scope of work at the start, so you know what your representation includes, whether that is a restraining-order hearing, a DUI defense, or an immigration filing.

Before you hire the firm, we explain the proposed scope of representation, the work included in your engagement, and any costs that fall outside it, such as filing fees or expert costs. Where a flat fee is not practical, we discuss payment plans that fit your situation.

Clear fee terms let you focus on your case instead of the meter. Ask about fee options during your free consultation.

Three Types of Domestic Violence Cases in New Jersey

A single domestic violence incident in New Jersey can lead to three separate legal proceedings, and each one follows different rules. In this video, Attorney Ade Omojola explains how they differ and why they must be handled together.

The first is a criminal case. Police may file charges such as simple assault, harassment, terroristic threats, or criminal mischief. These cases are prosecuted by the State in municipal court or Superior Court, and a conviction can bring fines, probation, or jail.

The second is a restraining-order case under the Prevention of Domestic Violence Act. It is heard in the Family Division of the Superior Court, such as the Ocean County Family Court for Toms River residents. A Temporary Restraining Order can be issued the same day, and a Final Restraining Order hearing usually follows within about ten days.

The third is a civil lawsuit, where one party seeks money damages for injuries or losses caused by the conduct.

What you say in one case can be used in another. Testimony at a restraining-order hearing, for example, may affect a pending criminal charge. A coordinated strategy protects your position across every proceeding.

Getting a Temporary Restraining Order in New Jersey

A Temporary Restraining Order, or TRO, is the first step in most New Jersey domestic violence cases. In this video, Attorney Ade Omojola explains the two ways a TRO can be requested.

During court hours, a person seeking protection can go to the Family Division of the Superior Court, such as the Ocean County Family Court, and file a domestic violence complaint. A judge reviews the complaint, often the same day, and decides whether to issue a TRO.

After hours, on weekends, or on holidays, the request can be made through a local police department. An officer takes the complaint and contacts a municipal court judge, who can issue a TRO by phone.

A TRO is issued without the other party present. It may bar contact, remove the defendant from a shared home, and require the surrender of firearms. The court then schedules a Final Restraining Order hearing, typically within ten days, where both sides can present evidence and testimony.

Whether you are seeking protection or have been served with a TRO, preparing for that final hearing early makes a meaningful difference.

Consequences of a Restraining Order in New Jersey

A Final Restraining Order in New Jersey is permanent unless a judge later dissolves it, and its effects reach well beyond the courtroom. In this video, Attorney Ade Omojola explains what an FRO can mean for the person it is entered against.

Once an FRO is entered, the defendant’s name is placed on the New Jersey Domestic Violence Central Registry. Employers and agencies that check the registry, including those in law enforcement, education, healthcare, and childcare, may see it.

An FRO also prohibits owning or possessing firearms and can bar a person from holding a firearms purchaser ID. Professional licenses, security clearances, and some immigration applications may be affected.

Restrictions can include no contact with the protected party, exclusion from a shared residence, and limits on parenting time. A violation of an FRO is a criminal offense under contempt laws.

Because the consequences are lasting, the Final Restraining Order hearing deserves careful preparation: reviewing the complaint, gathering messages and witnesses, and presenting a clear account of what happened.

When a TRO Becomes a Final Restraining Order

Not every Temporary Restraining Order becomes a Final Restraining Order. In this video, Attorney Ade Omojola explains the two elements a New Jersey judge must find before entering an FRO.

First, the plaintiff must prove that a predicate act of domestic violence occurred, such as harassment, assault, terroristic threats, stalking, or criminal mischief, as defined under the Prevention of Domestic Violence Act. The standard is a preponderance of the evidence.

Second, under the Silver v. Silver decision, the court must find that a restraining order is necessary to protect the plaintiff from immediate danger or further abuse. The judge considers the history between the parties, any prior incidents, and the circumstances of the relationship.

If either element is not proven, the TRO is dismissed. Some cases are also resolved through civil restraints, a negotiated agreement entered as a court order without a finding of domestic violence.

Understanding both elements shapes how evidence, text messages, and witness testimony are prepared for the hearing.

Why the Prosecutor Can’t Stop a Restraining Order Case

Many people assume that if the prosecutor drops criminal charges, the restraining order goes away too. In this video, Attorney Ade Omojola explains why that is not how New Jersey law works.

A criminal domestic violence case is brought by the State, so the prosecutor decides whether to pursue or dismiss it. A restraining-order case is a civil matter brought by the plaintiff in the Family Division, and the prosecutor is not a party to it.

That means a dismissed criminal charge does not end the restraining-order case. The Final Restraining Order hearing can still go forward, and the judge will decide whether a predicate act occurred and whether an order is needed for protection.

Only the plaintiff can ask to withdraw the restraining-order complaint, and the judge must be satisfied that the request is voluntary. Because the cases are separate, each one needs its own preparation.

Beating a Restraining Order Case in New Jersey

If you have been served with a Temporary Restraining Order in Toms River or Ocean County, the Final Restraining Order hearing is your opportunity to respond. In this video, Attorney Ade Omojola explains the paths to resolving that hearing.

At trial, the plaintiff must prove a predicate act of domestic violence and show that a final order is necessary for protection. The defense can challenge the account in the complaint, cross-examine witnesses, and present text messages, call logs, photos, and witnesses that tell a different story.

Some cases are resolved through civil restraints, a negotiated agreement that sets no-contact terms and is entered as a court order without a finding of domestic violence and without placement on the central registry.

Other cases are dismissed when the plaintiff chooses not to proceed. The right path depends on the evidence, your goals, and any related criminal, custody, or housing issues.

Removing a Final Restraining Order in New Jersey

A Final Restraining Order in New Jersey can remain in place indefinitely, but the law provides a process for asking the court to remove it. This is done by filing a motion to vacate with the court.

The challenge is that the court originally found that a predicate act of domestic violence occurred and that protection was necessary. While past conduct cannot simply be erased, the person requesting removal must often show that circumstances have changed and that the fear of future harm no longer exists.

Because the order usually prohibits contact with the protected party, gathering support for the motion must be handled carefully so that the existing restrictions are not violated.

Courts take these requests seriously. If you have a Final Restraining Order in Toms River or Ocean County and want to understand your options, call (732) 704-5021 to speak with Attorney Ade Omojola.

DUI/DWI Defense · Attorney Ade Omojola

Breath Tests and Refusal Charges in New Jersey

Breath testing is often central to a New Jersey DUI case, but the results are only reliable when proper procedures are followed. Attorneys review whether the Alcotest was properly maintained, whether required inspections were completed, and whether the officer conducting the test was properly trained and certified.

If there are problems with the equipment, maintenance records, certifications, or testing process, the reliability of the results may be questioned. Even so, prosecutors may still attempt to prove a DUI through the officer’s observations and testimony.

Refusing a breath test can create a separate legal issue. A refusal charge may be handled along with the DUI and carry its own consequences. Attorneys review whether the request was legally made, whether proper procedures were followed, and whether the driver was properly informed of the consequences of refusing.

If you are facing a DUI or refusal charge in Toms River, call (732) 704-5021 to review the evidence with Attorney Ade Omojola.
