Our clients include professionals, business owners, and high-net-worth individuals from around the globe who are ready to turn capital into opportunity—and secure the American dream for themselves a…

What is the EB-5 Visa?

The EB-5 Immigrant Investor Visa allows foreign nationals and their immediate families (spouse and unmarried children under age 21) to apply for permanent residency by investing in a qualifying U.S. business. This program was created by Congress in 1990 to spur economic growth through job creation and capital investment by foreign investors.

Key Benefits of the EB-5 Program

  • Green cards for the investor, spouse, and children under 21
  • No employer sponsorship or job offer needed
  • Freedom to live and work anywhere in the U.S.
  • Eligibility to apply for U.S. citizenship after 5 years of permanent residency
  • No English language or education requirements

EB-5 Investment Requirements

To qualify for an EB-5 visa, the investor must:

  • Invest a minimum of $1,050,000 in a U.S. business, or $800,000 if investing in a Targeted Employment Area (TEA)
  • Demonstrate the investment will create or preserve at least 10 full-time jobs for U.S. workers
  • Prove the investment funds come from lawful sources

What Is a Targeted Employment Area (TEA)?

  • Rural Area: Outside of a metropolitan statistical area (MSA)
  • High-Unemployment Area: Where unemployment is at least 150% of the national average

Direct vs. Regional Center Investment

The EB-5 program offers two investment paths. Each has unique advantages depending on your financial goals and desired involvement level.

Direct Investment
  • The investor directly operates or manages the business
  • Must directly hire 10 full-time employees
  • Ideal for entrepreneurs wanting hands-on control
Regional Center Investment
  • Managed by a USCIS-approved organization
  • Job creation may be indirect or induced
  • Popular with investors seeking passive roles

Types of EB-5 Projects

EB-5 capital can be used in a wide range of industries. Common project types include:

  • Real Estate Developments: Hotels, luxury apartments, senior housing, or office towers
  • Franchise Expansion: National restaurant chains or convenience store brands
  • Infrastructure Projects: Highways, transit centers, energy, and public-private partnerships
  • Tech Startups: AI, SaaS, fintech, clean tech, or biotech ventures

Omojola Law helps investors vet projects for feasibility, risk level, job creation potential, and immigration compliance.

Job Creation Criteria

  • Investment must lead to 10 full-time jobs for U.S. workers
  • Jobs must be created within two years of receiving the conditional green card
  • Regional Center projects may count indirect jobs (based on economic models)

Source of Funds Requirements

Transparency and Lawful Origin Are Essential

The cornerstone of any successful EB-5 application is proving that the investment capital comes from a legitimate and traceable source. USCIS rigorously examines the origin and movement of all funds. Failure to provide complete documentation can result in delays, RFEs (Requests for Evidence), or outright denial.

Acceptable Sources of Funds

  • Income from employment or self-employment
  • Dividends or proceeds from investments or business sales
  • Inheritance or legally documented gifts
  • Sale of property or real estate
  • Secured loans backed by the investor’s assets

Required Documentation

  • 5 years of tax returns from the investor and/or donor
  • Bank statements detailing transactions and transfers
  • Employment verification letters or business registration documents
  • Proof of sale documents (e.g., property deeds, contracts)
  • Loan documents and security agreements
  • Gift affidavits and donor source verification

Step-by-Step EB-5 Application Process

  1. Choose Investment Type: Direct or Regional Center route
  2. Select a Project: Based on job creation viability, financial feasibility, and legal compliance
  3. Gather Documentation: Financial records, source of funds, business plans
  4. File Form I-526 or I-526E: This is the investor petition that proves eligibility
  5. USCIS Review: Processing can take 12 to 36 months
  6. Receive Conditional Green Card: After petition approval, investor receives a 2-year conditional green card
  7. File Form I-829: Petition to remove conditions and verify job creation and sustained investment
  8. Apply for U.S. Citizenship: Eligible after 5 years as a permanent resident

Common Challenges in EB-5 Petitions

  • Incomplete source of funds documentation: Missing documents or unverifiable transfers raise red flags
  • Project failure or poor job creation: Investors risk losing status if the project doesn’t meet job creation goals
  • Processing delays: USCIS backlogs, particularly for high-demand countries (e.g., China, India, Vietnam)
  • Changing regulations: EB-5 program rules and TEA definitions change frequently, requiring close legal monitoring
